These terms govern your use of EquipLog (the “app”) and its related website and cloud services, provided by Bacalles Ventures LLC. By installing or using the app, you agree to these terms. If you do not agree, do not use the app.
The app helps you record and organize service history for units such as equipment, appliances, building systems, and vehicles: dates, work performed, costs, parts, filters, inventory, attachments, and reminders. It is a record-keeping tool, not a substitute for manufacturer service manuals, professional inspection, or manufacturer-recommended maintenance schedules.
An account is optional; the app works on your device without one. If you create an account, keep your sign-in details private and tell us if you think someone else has used them. Records are kept in organizations. The people who administer an organization decide who is invited and what role each person has, and are responsible for those choices.
You own the records you create in the app. You give us permission to store and process them only as needed to run the service for you. You are responsible for the accuracy of the information you enter and for keeping your own backups — use the built-in backup export regularly, especially before uninstalling the app, replacing your device, or clearing app data. Without cloud backup, data lives only on your device. We are not responsible for data lost due to device failure, accidental deletion, or uninstallation.
Cloud backup and team sync are offered with a paid plan for an organization, billed monthly or yearly. A new plan may begin with a free trial. If it does, a payment method is collected up front, and the plan renews and is charged automatically when the trial ends unless you cancel first. Plans renew automatically until canceled. Prices, billing periods, and any applicable taxes are shown before you subscribe. Payments are processed by Stripe.
You can cancel at any time. Cancellation takes effect at the end of the period you have already paid for, and you keep access until then. Except where the law requires otherwise, fees are not refundable. If you think you were charged in error, contact us and we will review it.
Each plan includes an amount of cloud storage, and more may be offered separately. When storage is full, new files may not upload until space is freed or added. We may limit uploads that are unusually large or that put the service at risk for other customers.
If a payment fails, cloud sync continues for a grace period while you update your payment method. After that, or after a plan ends, cloud sync turns read-only: you can still view and export your records and keep using the app on your device, but changes will not upload until the plan is active again. We do not delete your cloud records simply because a plan ended.
You agree not to use the app for any unlawful purpose, to attempt to reverse engineer or resell the app in violation of applicable app store terms, to attempt to access other people’s data, or to interfere with the app’s or the service’s normal operation.
The app is provided “as is” and “as available,” without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose, merchantability, or non-infringement. We do not warrant that the app or the cloud service will be error-free, uninterrupted, or that data will never be lost.
To the maximum extent permitted by law, Bacalles Ventures LLC is not liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the app, including loss of data, loss of profits, or equipment downtime, even if advised of the possibility of such damages.
We may update the app and these terms from time to time. If we make material changes, we will update the “Last updated” date above. Continued use of the app after changes take effect means you accept the revised terms.
You may stop using the app at any time by uninstalling it, and you may delete your account from the Account page. We may suspend or end access to the cloud service for abuse, security reasons, non-payment, or legal reasons, and we may discontinue or change the app at any time. Because your records are also stored on your device, you can export a backup beforehand.
These terms are governed by the laws applicable to Bacalles Ventures LLC, without regard to conflict-of-law principles, except where local consumer-protection law requires otherwise.
